1. Data Controller

We attach great importance to the protection of your personal data.

This privacy policy informs you under what circumstances and how we collect, use, protect and in certain cases share your data.

We recommend that you read this privacy policy before submitting any information. By using our services, you acknowledge that you understand and agree to the terms of this privacy policy.

Terms not defined under this privacy policy have the meaning given to them by PEAS'UP's Terms and Conditions.

The data controller of all your personal data collected by these Services is PEASUP, a simplified joint-stock company with a capital of 10,000 euros, whose registered office is 3 B RUE DU VIADUC, 94130 NOGENT-SUR-MARNE, registered under SIREN number 953 509 817 at the RCS of Créteil (designated in the Terms and Conditions as "PEAS'UP").

2. The use and storage of your personal data

We collect and process your personal data for the following purposes:

2.1. To allow you to access the Services offered through the Platform

During your visit to our Platform, we automatically collect, record and temporarily store the following information relating to your device and your visit:

  • The domain and host from which you access the Internet;

  • The Internet address of the website from which you directly accessed our Platform, if applicable;

  • The date and time you arrived on our Platform and how long you spent on it, as well as the pages you visited;

  • Your IP (Internet Protocol) address;

  • Your device's operating system and navigation software.

This information is used to allow you to access our site and for statistical purposes. This processing is based on our legitimate interest in processing your data.

This data is kept for the duration of your browsing session and then for one year.

2.2. To enable you to benefit from the Services

To access the Platform you will be asked to create an account and provide us with the following information:

  • Your identification details (email, password, username, gender, date of birth);

  • Your data relating to the organization of your family life (number of children and whether they live in your home or not);

  • Your professional data (your employer's company code, the team you are attached to which corresponds to the group created within the Platform, your role within the team).

This data is collected for the purpose of providing you with the Services in response to your registration or that of your employer on the platform. This processing therefore falls within the scope of Article 6(1)(b) of the GDPR, under which processing is lawful if it is necessary for the performance of a contract to which the data subject is a party or in order to take steps at the request of the data subject prior to entering into a contract, or Article 6(1)(a) of the GDPR, under which processing is lawful if it is based on the consent of the data subject.

As part of this processing, we keep your personal data in active database for the duration of the contract concluded with you or your employer and then for a period of five years in intermediate archiving for the purpose of proving compliance with our obligations towards you or your employer.

Registration and login on the Platform

Newsletter signup

If you sign up for our newsletters, we will use your email address to send you information and updates on the progress of your team members in your absence.

We may also use the data you provide to optimize our newsletter.

In this context, we may collect information about the successful receipt and timing of your receipt of our newsletter.

This processing therefore falls within the framework of Article 6(1)(a) of the GDPR, under which processing is lawful if the data subject has given consent to this processing, and Article 6(1)(f) of the GDPR, under which processing is lawful if it corresponds to the legitimate interest of the controller.

You can withdraw your consent and unsubscribe from the newsletter at any time by clicking the unsubscribe link in the newsletter.

As part of this processing, we keep your personal data in our active database until you object to the processing of your personal data.

Participation in Challenges and Courses

When you participate in Challenges or Pathways, we may collect the following data as a subcontractor on behalf of the client entities that employ you:

  • Your identification details (email, password, username, gender, date of birth);

  • Your professional data (your employer's company code, the team you are attached to which corresponds to the group created within the Platform, your role within the team);

  • Your Platform usage data (number of Peas earned which allows us to measure the progress of each User and is based on the impact generated; a certain number of Peas are awarded for each challenge and each action completed; number of Challenges completed including the theme of the action, contributions, ideas, content, etc., that you share in response to the Challenges)

The data collected as part of this processing is shared with the client entity, which is your employer, in a non-personally identifiable manner, unless you give us explicit permission, in the form of aggregated data and statistical reports.

For more information on the processing of personal data carried out in connection with the use of the Services, the User can contact their employer who is a client entity of our Services.

If you wish, you can also share your progress, learning and actions with your communities via internal and external communication channels at PEAS'UP.

This processing therefore falls within the scope of Article 6 (1)(a) of the GDPR under which processing is lawful if the data subject has given consent to this processing.

Your data will be kept in active database for the entire duration of your use of the Platform and then for a period of five years in intermediate archiving for the purpose of proving compliance with our obligations towards you.

2.3. To allow us to improve our Services

When you use our Services, we may use some of the information you provide to improve our Services:

  • the ideas and contributions that you share on the Platform in response to Challenges to allow us to build new Challenges or Paths;

  • the comments, ratings and more broadly feedback that you leave us during your use of the Platform, in particular for each challenge and action completed.

This processing allows us to improve our Services (for example, to rephrase a misunderstood question or remove a rarely completed Challenge) as well as to provide information to other Users on the different Challenges and Paths.

This processing therefore falls within the scope of Article 6(1)(f) of the GDPR, under which processing is lawful if it corresponds to the legitimate interest of the data controller.

As part of this processing, we keep your personal data in our active database until you object to the processing of your personal data.

2.4. To allow us to better understand you and improve our Services

When you use our Services we may collect information relating to your family and personal habits, your lifestyle and consumption habits, your levels of sensitivity to environmental issues and establish your maturity profile with regard to these issues.

This data is used to allow us to improve our Services for your benefit (e.g., to offer you suitable Challenges and Missions) or for the benefit of third parties (e.g., to adapt our Challenges and Missions according to a category of people with common characteristics).

This processing therefore falls within the scope of Article 6(1)(f) of the GDPR, under which processing is lawful if it corresponds to the legitimate interest of the data controller.

As part of this processing, we keep your personal data in our active database until you object to the processing of your personal data.

Finally, we may use the data we collect in this context to produce non-personally identifiable usage reports in the form of aggregated data and statistical reports.

2.5. To allow us to collect a commission from partner companies

The Platform contains links to third-party partner sites which may offer you products and services independently of our Services.

When you purchase products and services from a partner during a Challenge or a Journey, we ask you, where applicable, to provide details of the purchase made from that partner by sending us the date of your purchase, the amount of your purchase and the type of product purchased.

This information allows us to receive a commission from our partner companies.

This information is not mandatory.

This processing therefore falls within the framework of Article 6(1)(a) of the GDPR, under which processing is lawful if the data subject has given consent to this processing, and Article 6(1)(f) of the GDPR, under which processing is lawful if it corresponds to the legitimate interest of the controller.

As part of this processing, we keep your personal data in active database until we receive the commission from our partner and then for a period of five years in intermediate archive for evidentiary purposes.

3. Recipient or category of recipients

Your data is intended for PEAS'UP when PEAS'UP acts as data controller or for the client entity that has subscribed to a subscription on the Platform when PEAS'UP acts as a data processor.

When PEAS'UP acts as the data controller, your data may also be shared with external advisors and auditors. Furthermore, in order to provide you with our services and manage your data, we may use third parties acting as data processors. This includes data processors established outside the European Union or the European Economic Area, in which case we will ensure that appropriate measures are in place to protect your personal data, in particular through standard contractual clauses of the European Union concluded between us and the data processor.

4. Use of cookies

We use cookies on our Platform. Cookies are small, temporarily stored files used for various purposes, which are described below. We use our own cookies, particularly functional cookies, to make our Platform more user-friendly, to facilitate navigation and the use of our forms, to simplify login and registration, to provide certain functions, to store cookie consent or rejection, and to ensure the security of our Platform and systems. These cookies are therefore necessary to use our Platform effectively. Consent is not required for these specific cookies.

5. Your rights

You have the right to access, rectify, and erase your personal data, as well as the right to restrict its processing. If the processing is based on PEAS’UP’s legitimate interest, you also have the right to object to the processing. Insofar as the processing of your personal data is based on your consent, you may withdraw your consent at any time, without affecting the lawfulness of the processing carried out before the withdrawal of your consent. In accordance with Article 12.5 of the GDPR, PEAS’UP may refuse to comply with your request if it is manifestly unfounded or excessive. In accordance with Article 40-1 of the French Data Protection Act, you may define instructions regarding the retention, erasure, or communication of your personal data after your death. If your instructions are general and concern all your personal data, they may be registered with a trusted digital third party certified by the French Data Protection Authority (CNIL). If your instructions are specific to the personal data collected by PEAS’UP, they are registered with the CNIL itself. You can modify or revoke your instructions at any time. You have the right to lodge a complaint with a competent supervisory authority, as defined by the General Data Protection Regulation (GDPR) and applicable laws, if you believe that your personal data is being processed in violation of the GDPR. To do so, you can contact the competent supervisory authority in the European Union Member State of your habitual residence or the place where the alleged infringement occurred. Our supervisory authority is the French Data Protection Authority (CNIL), whose contact details can be found at www.cnil.fr.

7. Shelf life

Data retention periods vary and depend on the nature of the data and the purposes for which it is processed.

The retention periods applicable to the processing of your data are specified above, purpose by purpose. Once the purposes for processing the data have been fulfilled, and taking into account any legal or regulatory obligations requiring the retention of certain data, we will delete or anonymize your data. When personal data is collected for multiple purposes, it is retained until the longest retention or archiving period has expired.

8. Changes to the Privacy Policy

We reserve the right to modify this privacy policy at any time.
